West Valley City man charged with automobile homicide

A West Valley City man was charged Monday with automobile homicide after police say he was driving while drunk before a collision that killed a 76-year-old man.

Gary Ray Marshall, 53, was charged in 3rd District Court with a second-degree felony for a crash on March 31 at 3700 S. Redwood Road that killed Richard Learned of Sandy.

Charging documents say tests showed Marshall had a blood-alcohol content of 0.129, more than double the legal limit of 0.05. They also say that he was driving more than 68 mph in a 40 mph zone.

A witness said she saw a car driven by Marshall switch lanes and hit an SUV carrying Learner, causing it to spin twice and then roll. Learned was partially ejected from his vehicle.

The Utah Medical Examiner’s office said, according to charging documents, that Learned died from a combination of the injuries suffered in the crash to his head, spinal cord, ribs and lungs, plus pre-existing health conditions.
