Man who allegedly assaulted Starbucks clerk and was then shot by customer is charged

A man has been charged with aggravated assault and criminal trespass after he allegedly assaulted an employee at a Millcreek Starbucks — and was shot by a customer at the coffee shop.

Benjamin Scott Overall, 37, remains hospitalized after the Oct. 4 incident at the Starbucks at 3898 S. 900 East. According to the probable cause statement, he entered the coffee shop “and assaulted one of the workers ... punching her in the face, hitting her in the head with a metal basket, and then kicking her.”

The customer, who has a concealed carry permit (and whose name has not been released) “shot Overall once to protect himself and others.”

Police obtained Starbucks' security video, which shows Overall assault the woman “and then advance on” the customer “before being shot. The video then shows Overall advancing on police and having to be physically taken to the ground.”

Overall has been charged with aggravated assault, a third-degree felony, and criminal trespass, a class-B misdemeanor.

He remains hospitalized in serious condition, according to police.
