“Conversion therapy” is a misnomer. It is not therapy, and it does not result in conversion. It does not change a child’s sexual orientation or gender identity. This is “settled science.” Credible, scientific research has established these facts. It has also been demonstrated that therapists who engage in this practice with minors cause significant psychological harm and precipitate suicidal ideation and attempts. Therapy is intended to heal, not harm and it is every therapist’s responsibility to safeguard the wellbeing of their clients. Unfortunately, there are those who nevertheless wish to engage in this practice.
The current Division of Occupational and Professional Licensing rule prohibits a therapist from engaging in “any practice or treatment that seeks to change the sexual orientation or gender identity of a patient or client.” This language only applies to minors who are in therapy. The rule specifically states that a therapist is allowed to provide treatment that is neutral with respect to sexual orientation or gender identity, helps them engage in identity exploration and development, and discusses the child’s moral or religious beliefs or practices. As long as the therapeutic intent is not to change the minor client’s sexual orientation or gender identity, there are no limits or restrictions on a therapist’s ability to address these issues. This rule provides clear guidelines for therapists, as well as protection for children at risk of being harmed by this practice.
