Man charged after he was wounded in shootout with Orem police

No officers were injured in the exchange of gunfire.

An Orem man is facing multiple charges after he was wounded by police in a shootout at his home on Sept. 29.

Zackrey Gage Newman, 31, was charged in 4th District Court with two counts of assault against a peace officer, second-degree felonies; two counts of discharge of a firearm, third-degree felonies; and one count of domestic violence assault and two counts of commission of domestic violence in the presence of a minor, class B misdemeanors.

According to a probable cause statement, at about 4 a.m., Newman and his wife got into an argument, and he slapped her two or three times. She locked herself and their two children in the master bedroom of their apartment, near 400 South and 700 East, but Newman broke down the door. He pointed at his wife and the children, the statement said, and told them, “You’re done. You’re all done,” and began punching his wife.

When Newman went into the living room, where he keeps a gun, his family climbed out the window of the master bedroom and went to a neighbor’s home. His wife told police that as they were leaving, she heard a gunshot from the living room.

Police officers surrounded the apartment and ordered Newman to come out with his hands up. He refused and, according to police, said, “One of us is going to die tonight”; “I am not going to jail”; “If I come up there, one of us is going to die”; and “Are we all shooting now? I have tons of ammunition.”

According to court documents, at 5:15 a.m., Newman pointed his gun out the front door of his apartment and fired once at three police officers. Police body camera footage shows the round striking a handrail between Newman and the officers, who returned fire. A minute later, Newman fired another round at the officers, who said they heard another shot from inside the home two minutes after that.

Police reported that they saw that Newman had been wounded and was bleeding, and offered medical assistance. Newman said he would not open the door without pulling the trigger, police said. Almost 5½ hours later, he came out of the apartment without his gun and stood in the driveway. And, according to police, he “appeared to be consuming an alcoholic beverage.” He turned around to reenter the apartment, but was taken into custody.

Newman was taken to a hospital to be treated for his gunshot wound. He was later booked into the Utah County jail, where he is being held without bail.

No police officers were injured.
