A Washington state judge has scheduled a trial date over the death of Susan Cox Powell’s children for early next year, according to court documents obtained by FOX 13.
Powell’s parents, Judy and Chuck Cox, are suing the Washington State Department of Social and Health Services, saying the agency should have done more to prevent the deaths of the two young boys in 2012. The trial is set to begin in February.
Susan Cox Powell went missing from her home in 2009 and has never been found. Her husband, Joshua Powell, later moved to Washington, where he killed his sons using a hatchet and then himself by blowing up the house. Joshua Powell was long considered a suspect in Susan’s disappearance.
The sons were in state protective custody while police investigated Josh’s father, Steven Powell, for voyeurism. Steven was convicted and died in prison in July 2018.
