Utah man charged in gang-related shooting death

He is also charged with tampering with evidence for allegedly hiding murder weapon.

The alleged triggerman in a gang-related shooting in Ogden last week has been charged with murder.

Devin Brock Smith, 18, was charged Monday in 1st District Court with first-degree felony murder in the death of 29-year-old Miguel Angel Rios.

Smith also was charged with second-degree felony tampering with evidence for allegedly hiding the murder weapon, and third-degree felony possession of a firearm by a restricted person.

Jeremy Anthony Moncada, 18, who allegedly was with Smith during the shooting, was charged with second-degree felony tampering with evidence and third-degree felony possession of a firearm by a restricted person.

Ogden police have said that both men have a documented gang history and that the victim was believed to have belonged to a rival gang.

Smith told police that prior to the shooting, he exchanged words and gang signs with Rios, according to charging documents.

And when Rios "flexed on him," Smith told police, Smith pulled a .22-caliber revolver he had been carrying for several weeks and shot the victim several times, charges state.

According to the online Urban Dictionary, to "flex" is "to show off."

Officers found Rios shortly after 2:40 p.m. Friday when they were called to a residence near Adams Avenue (500 East) and 31st Street. He was taken to a local hospital, where he later died, a police news release said.

Investigators learned the suspects had been spotted running from the scene to a residence near Porter Avenue (600 East) and 30th Street, where they took the two men into custody.

Before police arrived, Smith had given the gun to Moncada, who hid it in a crawl space at the Porter Avenue home, charges state.

The two suspects also changed their clothing in an effort to conceal evidence of the crime, according to charges.

Both Smith and Moncada have been deemed "restricted persons," for whom possessing a firearm was illegal. Each has prior felony convictions, and they both admitted to consuming an unspecified drug earlier on the day of the shooting, charges state.

Smith was charged as a minor with assault by a prisoner in 2014 and burglary of a dwelling in 2012, charges state.

As an adult, Smith pleaded guilty in 2015 in Ogden Justice Court to disorderly conduct, a class C misdemeanor, and was placed on probation for a year. He was charged earlier this year with attempted failure to stop at the command of law enforcement, pleaded guilty to a class B misdemeanor and was sentenced to 10 days in jail.

According to court records, Moncada was charged in 2015 in Riverdale Justice Court with use or possession of drug paraphernalia, a Class B misdemeanor, and was later placed on probation for six months. In January, he pleaded guilty to a class C misdemeanor count of giving a false personal identity to a peace officer and was sentenced to 30 days in jail.
