A November evidence hearing has been set for a fleeing but unarmed suspect who was shot and wounded by a police officer following a traffic stop in Kearns earlier this month.

Damian Scott Huth, 20, is charged in 3rd District Court with third-degree felony escape in connection with the episode.

At the Nov. 15 preliminary hearing, prosecutors will present evidence against Huth and a judge will decide if the case should proceed to trial.

Kelli Rachelle Huth, 18 — who allegedly attacked another Unified Police Department officer, allowing her husband to flee — is charged with third-degree felony obstructing justice and class A misdemeanor assault against a police officer. She is to appear in court for a scheduling hearing on Nov. 3.

On Oct. 5, two UPD officers stopped a car near 5800 West and 6200 South in which Damian Huth was a passenger. The officers had been informed that Huth — who had outstanding warrants — was a passenger, according to charging documents.

When Officer Michael Khong pulled Huth from the back seat of the car, he struggled with Khong and they fell to the ground, charges state.

Kelli Huth then exited the car and jumped onto Kohng's back and pulled him off her husband, who fled on foot, charges state.

UPD Officer Cordell Whitmore chased Damian Huth to a nearby location where he shot Huth in the shoulder, police have said.

Huth did not have a weapon, and Salt Lake County Sheriff Jim Winder has said it was unclear why Whitmore — an eight-year veteran with the department — fired his gun. The officer was not wearing a body camera, due to "financial constraints" in the department, Winder has said.

The Salt Lake City Police Department is investigating the shooting.

Whitmore, who has been placed on paid administrative leave, suffered cut hands and a lacerated abdomen, probably from scaling a barbed wire fence during the pursuit, Winder has said.

Two arrest warrants for Damian Huth were issued last month by 3rd District Court judges.

In one case, Huth was charged in August with class A misdemeanor possession of cocaine and class B possession of drug paraphernalia after a Salt Lake City police officer saw him sitting at 360 S. 500 West with "three white small rocks" in his hand. A $2,500 warrant was issued Sept. 26 after Huth failed to show for his initial court appearance.

The other case, filed in 2014, stemmed from a fight that Huth, then 18, had with his 14-year sister and father, in which he choked his sister and punched and bit his father and threatened to hit the older man with a metal scooter.

Huth was charged with two counts of third-degree felony aggravated assault, but pleaded guilty to reduced class A misdemeanor counts. Huth was sentenced to probation with jail time and in-patient treatment. A no-bail warrant was issued on Sept. 9 for allegedly failing to stay in contact with his probation officer, court records show.
