The man shot and killed in an apparent hunting accident during the weekend has been identified as 49-year-old James Townsend, of Weber County.

Townsend had been accidentally shot in the head by his older brother during an antelope hunt in northeastern Utah's Little Creek Reservoir Area on Sept. 13.

In a Facebook posting, Rich County Sheriff Dale Stacey said his deputies, along with the Utah Division of Wildlife Resources and the Utah attorney general's office, had completed their investigation.

"Investigators will now meet with the Rich County prosecutor's office in the coming days to discuss the details of this case and determine if any charges will be filed," the statement read. Stacey said earlier the shooting appeared to have been accidental.

Preliminary investigation indicated the brothers were riding one four-wheel ATV, stopped and Townsend had gotten off, taken a shot at an antelope and missed. A moment later, the older brother — apparently tracking the animal from the ATV with his rifle scope — fired.

It was still unclear whether Townsend may have stood up at the time his brother shot.
