A 76-year-old man who police say was sunbathing nude in his backyard next to a church parking lot in Farmington has pleaded not guilty to lewdness charges.
Myron Lee Kipp is charged in Farmington's 2nd District Court with seven misdemeanor charges: four counts of lewdness involving a child and three counts of lewdness.
He pleaded not guilty to the charges on Wednesday during a court appearance. An Oct. 14 pretrial conference was also set Wednesday, along with a Nov. 10 jury trial, according to the Standard-Examiner.
According to a probable cause statement, a police officer was called to Kipp's home on March 5 after witnesses saw the man sunbathing nude in his backyard.
Three adults and four children at a nearby church parking lot were able to see through the man's chain link fence, police said, and saw the man naked. Kipp's fence does not have privacy slats, police noted in court documents.
When confronted, a completely nude Kipp told the officer that "he was sun bathing and that it was his property and he could do it if he wanted," according to the probable cause statement.
