A 28-year-old man who gained notoriety over the summer when he was mistakenly released from jail after being arrested on suspicion of rape and burglary has been sentenced to spend up to 15 years in the Utah State Prison.
Anthony Santos Moultry, who was accused of sexually assaulting a woman after he forced his way into her Murray apartment, pleaded guilty in December to second-degree felony attempted rape.
He was taken into custody immediately following the Feb. 3 sentencing.
Third District Judge Robin Reese also ordered Moultry pay at least $1,696 in restitution to the victim.
In exchange for his guilty plea, prosecutors dropped three additional charges: burglary, a second degree felony, and misdemeanor counts of theft and lewdness.
According to charging documents, Moultry entered the female victim's apartment near 900 E. Pineway Drive (4900 South) in Murray in the early hours of Aug. 3 and repeatedly sexually assaulted her while threatening to kill her.
After allegedly forcing the victim to watch him masturbate, Moultry allegedly stole the victim's wallet before he left.
Four days after he was arrested, Moultry was released from jail after having reached the statutory 72-hour limit on incarceration without formal charges being filed against him. But this was a mistake, as an incarceration extension order had been filed by prosecutors — which was missed by Moultry's jailers somewhere along the way.
A manhunt was launched and Moultry was recaptured within several hours of his release.
