Lawyer: Midvale triple homicide obstruction suspect to plead

West Jordan • The man accused of obstructing justice in a February triple homicide in Midvale is expected to plead guilty in the case next week.

Davis Romney Fotu, 33, waived his right to a preliminary hearing Tuesday in 3rd District Court, thereby acknowledging that prosecutors have enough evidence to show probable cause that he committed a crime.

But Fotu did not plead to the charge against him: one count of obstructing justice in connection with the Feb. 12 shooting deaths of Danielle Lucero, Omar Jarman and Shontay Young.

If convicted of the second-degree felony charge, he could face up to 15 years in state prison.

Fotu's attorney, Rudy Bautista, said his client will enter a plea next week, but would not discuss the details of the negotiation or agreement.

"We do anticipate the case being resolved next week," said Bautista, who has been negotiating with prosecutors for months.

According to charging documents, Fotu was inside a home at 8286 S. Adams St. (450 West) in Midvale the morning of Feb. 12 when alleged shooter David Fresques went room-to-room killing the people inside, police said.

After the shootings, Fotu gave Fresques his truck and told him to take it somewhere safe, the charges allege. Someone then called police and reported the truck had been stolen. Fresques was captured the next day, court documents state, when he crashed Fotu's truck into a parked car near 3700 S. and 300 East.

Fotu was arrested in March during an unrelated probation check after a weeks-long manhunt.

Fresques, 26, who faces three counts of aggravated murder and one count of attempted aggravated murder in connection with the slaying, is scheduled to appear in court for a preliminary hearing this month.
