The last of seven people involved in a June 2011 fatal shooting in Uintah County was sentenced Tuesday.

James Carey, 25, was fatally shot late on June 18, 2011, outside a home on State Road 121 in LaPoint. Jared Hurley, 36, was wounded. Four brothers and two other individuals were arrested and charged with homicide, attempted murder and aggravated assault in what police believe was a gang-related shooting.

Triggerman Bruce Silva, 24, was sentenced in June 2012 to 15 years to life in prison for the fatal shooting. He pleaded guilty to one first-degree felony count of murder and a second-degree felony count of aggravated assault resulting in serious bodily injury in 8th District Court in Vernal. Seven other charges were dismissed as part of a plea agreement.

Teauna Cesspooch, 20, was sentenced Tuesday in 8th District Court to two consecutive years in jail with all of it credited to time already served. Cesspooch's attorney, Greg Skordas, said Tuesday that Cesspooch has been in jail since June 2011. Cesspooch accepted a plea deal and pleaded guilty to two counts of felony aggravated assault, along with misdemeanor assault and committing a violent offense in the presence of a minor.

Sentencing Judge Edwin Peterson also gave Cesspooch a three-year "no tolerance" probation, specifying that she undergo counseling for drug and alcohol abuse as well as mental health treatment. She also was required to complete her GED, which she started in jail, according to Skordas. If she violates any condition of her probation during the three-year term she will be sent to prison for 15 years, Skordas said.

According to a probable cause statement filed in court, Bruce Silva and a group of people pulled up to the residence on SR 121 in a pickup truck driven by Cesspooch. According to witnesses, four of the people in sitting in the bed of the truck had bats in their hands and were wearing red shirts.

As the groups from inside and outside the house met on the porch, Bruce Silva — who had been at the home earlier that night and was upset about a broken window on his car — asked for a gun. Cesspooch gave the gun to Colin Manning, 24, who in turn gave it to Bruce Silva.

According to a witness, Bruce Silva — who the witness knew as a Bloods gang member nicknamed "Psycho" — yelled at the group on the porch, "This is Bruce's territory," before firing the gun into the crowd, hitting Carey in the head and Hurley in the arm and lower chest area, according to court documents. Three children under the age of 14 were inside the home, according to charging documents.

Bruce Silva's brothers — Adrian Silva, 24, Kevin Silva, 22, and Alberto Silva, 20 — also were charged in the crime, along with Cesspooch and Bruce Silva's girlfriend, Shadow Reed, 24.

The three brothers and Reed took plea deals last year, pleading guilty to the same charges as Cesspooch. They all were sentenced to one to 15 years in the Utah State Prison.

As part of their deals, all of the people involved agreed to testify against one another if any of their cases went to trial.

Manning, a member of the Ute Indian Tribe, was sentenced in January to eight years in the Arizona Federal Prison.
