The case against an Orem man accused of telling a woman he met on LDSSingles.com that "no" actually meant "yes" as he allegedly raped her was dismissed Friday.

Claudiu Marius Bora, 33, was scheduled to appear in 4th District Court for a preliminary hearing Friday, but it was cancelled after prosecutors filed a motion to dismiss the charges against him.

Prosecutors did not immediately return calls for comment Friday, but because the case was dismissed without prejudice, it is possible the charges could be refiled against Bora in the future.

Bora, who allegedly raped a woman he met on LDSSingles.com after hiking in Rock Canyon in July, was charged with rape and object rape, both first-degree felonies, and forcible sexual abuse, a second-degree felony.

According to charging documents, Bora and the victim met after talking online at the Provo Temple to go hiking in Rock Canyon on July 6. Bora tried to kiss the woman, but she rebuffed his advances.

When they returned to the parking lot, the woman was placing her purse in the back seat of her SUV when Bora shoved her into the back seat of the car. That's when he raped her, police said.

During the assault, police said the woman tried to fight Bora off and said "No." But, officials said, Bora told the woman, "Didn't you know that 'no' means 'yes.' "

Police said the woman's skirt was torn during the assault and she suffered lacerations to her genitals.
