The Utah Highway Patrol said Mercurio, 31, was driving under the influence on the morning of Aug. 4 when she hit and killed 31-year-old Aaron R. Simms, who had been pulling weeds along the side of the road.

Mercurio lost control of her Pontiac G6, crossed the center line and went off the side of the road, hitting Simms near 800 E. Ridge Road.
