A lawsuit against a former Utah Jazz player and his wife, who allegedly failed to pay for space they leased for a clothing store, has been settled out of court.

Inland Western Salt Lake City Gateway, LLC, which owns and operates The Gateway mall, claimed Andrei Kirilenko and his wife, Marina Lopatova, also known as Masha Kirilenko, violated a lease agreement pertaining to Bezurk LLC, which did business as Fleur de Lis.

In December, the downtown mall filed suit in 3rd District Court, claiming the Kirilenkos owed nearly $167,000 in unpaid rent.

Bezurk first signed a five-year lease in 2007, but in 2009 agreed to a second three-year lease to acquire additional space, according to the lawsuit. Both leases were to end in 2012.

The mall owners claimed Andrei Kirilenko personally guaranteed payment of all Bezurk obligations. But Bezurk stopped paying the second lease in June 2010, and stopped paying on the first lease last October, the lawsuit said.

Attorney J. Gregory Hardman, representing The Gateway, said Thursday the lawsuit had been resolved to the satisfaction of parties.

The case was dismissed on Tuesday.

Andrei Kirilenko now plays for the Russian basketball team CSKA Moscow.
