Ogden • A legal dispute over the Sierra Club's denied request for Ogden City records concerning development of an urban gondola has now been settled, and 43 of the 46 emails have been released.

The gondola plan, now dormant, suggested a route that led to a proposed resort near Malan's Basin. The records request, made under the Government Records Access Management Act, dates back to mid-2007, said Sierra Club volunteer Dan Schroeder.

While the Sierra Club received some documents, the city withheld 46 emails, which led to a lengthy legal battle in 2nd District Court. The recent settlement dictates the release of all but three, with both sides agreeing those were rightfully withheld.

The city also must reimburse the Sierra Club for $10,000 in legal fees.

Attorneys Joel Ban and Patrick Shea, who represented the Sierra Club, read the three emails and agreed that they were legitimately withheld as attorney-client communications.

A statement released early Friday said that the Sierra Club considers the settlement a full victory, aside from the three-year delay in getting the "vast majority" of the records.
