Provo puts off discussion on daytime curfew proposal

Provo • The Municipal Council will wait two more weeks to discuss a daytime curfew for schoolchildren.

The council was poised to discuss the proposed ordinance at its work session Tuesday, but Deputy City Attorney Ryan Wood asked that the discussion be tabled. The reason: Wood hadn’t had a chance to discuss the proposal with prosecutors who would handle the cases.

Wood said he was planning to meet with Deputy Utah Attorney Paul Wake and school district officials Thursday to discuss the matter.

The ordinance was requested by the city’s gang task force as a way to crack down on gang activity. The school district reported having more than 800 truant students in the 2009-10 school year.

The council voted 5-1 to table the matter until February. Councilman Sterling Beck cast the dissenting vote. Beck has objected to the ordinance because he believes it will subject home-schoolers to harassment.

In a nod to Beck, the council earlier agreed to consider making violations a secondary offense.
