A 68-year-old registered sex offender is facing felony and misdemeanor charges.

Frank Montoya Sr. was charged Wednesday with one count of aggravated sexual abuse of a child and attempted aggravated sexual abuse of a child, both first-degree felony charges.

Montoya also faces two misdemeanor counts of a sex offender in the presence of a child, one count of driving under the influence of alcohol and or drugs, and one count of having no evidence of insurance, all misdemeanor charges.

Murray police stopped Montoya as he was backing out of a parking stall at Fashion Place Mall after a mall employee reported seeing him stumbling as if intoxicated.

A breath test showed he had a 0.148 percent blood alcohol level, documents show.

Police said a 12-year-old girl and an 11-year-old girl were in the back seat of the truck with Montoya when he was stopped. According to arresting documents, Montoya had taken the girls to dinner and shopping.

The girls told police he had fondled them while they were having dinner and trying on clothes, charging documents say.

Montoya later told police "he has lusts and sexual urges" that he has been suppressing for a long time and he "is no longer going to hold back from doing things that make him happy," charging documents say.
