BIloxi, Miss. • A 45-year-old Biloxi man accused in the shooting death of a Waffle House server after she told him not to smoke is due in court for his initial appearance.

The Sun Herald reports (http://bit.ly/21oQWo2 ) that Justice Court Judge Albert Fountain is presiding over the 10 a.m. Monday initial hearing for Johnny Mount. The former Biloxi firefighter was arrested on a charge of first-degree murder in the Friday slaying of longtime server 52-year-old Julie Brightwell.

Mount is being held on a $2 million bond.

Biloxi police arrested Mount as he was walking out of the restaurant around 1 a.m. Friday.

Police say Brightwell was trying to get Mount to stop smoking in the restaurant when he pulled out a handgun and shot her.
