New school boards a dilemma

The Salt Lake County Clerk's Office is sticking with what it knows while officials try to figure out how a new law affects seats available for two new school boards being formed to represent the two districts that will result from the dissolution of Jordan School District.

Gov. Jon Huntsman Jr. on Friday signed SB71, a bill detailing some procedures for splitting school districts. Among other provisions, it specifies that existing Jordan board members will automatically occupy comparable seats on one of the two new school boards.

However, County Clerk Sherrie Swensen said Friday the District Attorney's Office still is interpreting whether existing Jordan board members will serve the entire terms of seats on the new boards or will see those terms expire based on their terms on the current Jordan board.

If attorneys decide they will serve full terms on the new boards regardless of when they were elected to the existing board, other candidates will not be able to run for those seats on the new boards this year.

Swensen said any candidates who filed to run for a seat determined not to be open will be refunded the $25 filing fee.

Because the election filing period began just two days after the Legislature ended, Swensen said her office decided to let everyone file for all seats until Huntsman signed the bill and all questions were cleared up.

Swensen said she also is still in need of direction on what to do if existing Jordan board members opt not to take their seats on the new boards. Ellen Wallace has already said she will not take a seat on a new board.

"It's really confusing, and here we're kind of stuck in the middle of this change," Swensen said. "We're working through it."

As of Friday, 71 people, including incumbents, had filed to run for one of the Jordan boards.

SB71 takes effect May 5. Monday is the election filing deadline.

How to file

Through March 17, candidates wanting to run for a school board position can file at the Salt Lake County Clerk's Office, Elections Division, 2001 S. State St., Suite S1100. Office hours are 8 a.m. to 5 p.m., Monday to Friday. The filing fee is $25.
