Man charged with three felonies in traffic death of Utah family

Posted: 1:06 PM- The man accused of driving while intoxicated and killing three members of a Cedar Hills family on Christmas Eve has been formally charged with three counts of automobile homicide, a third-degree felony.

Carlos Rodolfo Prieto, 24, also faces two counts of driving under the influence of alcohol or drugs and one count of failing to obtain a drivers license. Prieto's immigration status is under review. On Wednesday, U.S.

Immigration and Customs Enforcement officials placed a hold Prieto, believed to be an undocumented immigrant from Mexico.

Federal authorities have interviewed Prieto but declined to say what he told investigators.

According to a police affidavit, however, Prieto admitted to drinking alcohol before driving his pickup truck, which struck the Ceran family in a Murray intersection about 2:30 a.m.

Police said Prieto "had a strong odor of alcohol on his breath, slurred speech and distinct nystagmus," according to the charges. A preliminary blood sample drawn by a paramedic showed his blood alcohol level to be in excess of the legal limit, according to court documents. Final results pending a toxicology report, state the charges. The crash killed Cheryl Ceran, 47, and two of her children, 15-year-old Ian and 7-year-old Julianna.

Gary Ceran, 45, and children 19-year-old Clarissa, and 12-year-old Caleb were injured. All have been released from the hospital and returned home, according to a hospital spokesperson.
