Murder charge filed in Kearns shooting death

The man accused of a slaying in Kearns last week has been charged with first-degree felony murder.

Joshua James Montoya, 26, faces up to life in prison if convicted. Montoya is accused of murdering Amos Pacheco Friday.

The charges say Pacheco was dating the mother of Montoya's children. Pacheco and the mother delivered the children to Montoya's house.

Montoya walked past the mother and children and argued with Pacheco while he sat in a truck, court papers say. Montoya allegedly drew a silver handgun. The mother ran into the house and called police.

When the mother came back outside, Montoya shot Pacheco, according to court documents. A medical examiner determined Pacheco, 25, died from a gunshot wound to the chest.

Montoya also is charged with a felony count of obstructing justice for allegedly hiding the gun in a dresser.

Montoya remains in the Salt Lake County jail in lieu of $1.25 million bail.
