Roosevelt officer cleared in fatal shooting

A Roosevelt police officer has been cleared in the fatal shooting of a burglary suspect who drove his car toward the officer.

Officer T. J. Bird tried to pull over Magna resident Gary Wheeler after spotting him at the scene of a robbery at Big O Tires in Ballard, but Wheeler fled, leading Bird on a chase through neighboring Roosevelt, according to a statement released by the Duchesne County Attorney's office.

Bird cut off the stolen car Wheeler was driving; Wheeler, 44, then rammed Bird's police car with the truck and tried to back up, but the tires spun on ice alongside the road, according to the statement.

Bird brandished his gun, opened the passenger door of the truck and ordered Wheeler to get out. Wheeler took his foot off the gas pedal and opened the door. As Bird walked in front of the truck to approach Wheeler, Wheeler got back in the truck and drove it toward Bird, according to the statement.

Bird fired on Wheeler, who died of his injuries. Prosecutors wrote the shooting was justified, and Bird faces no criminal charges.
