Police catch suspect in fatal Kearns shooting

A 25-year-old man sitting in an SUV was shot and killed Friday night after an argument broke out in a Kearns neighborhood.

Unified Police Department Lt. Don Hutson said Amos James Pacheco was shot in the chest and 26-year Joshua James Montoya was arrested in connection with his death.

Montoya ran from the scene of the shooting outside his home near 5700 South and 4600 West, UPD Sheriff Jim Winder said. Dozens of UPD officers and other police agencies searched for Montoya until about 10 p.m. when he was found coming out of a home in West Valley City. He got into a car and was immediately stopped by police and arrested near 4100 South and 6000 West. Hutson said it was unclear if the gun was recovered.

The UPD responded to reports of the shooting around 5:30 p.m.

Prior to the shooting, Pacheco arrived at Montoya's home with his girlfriend, who is either Montoya's former wife or girlfriend, said Winder.

The couple were dropping off the woman's three children, ages 9, 8 and 4. Montoya is the father of the children, Winder said.

The children went inside the house, while Montoya left the house and approached the SUV. Police are not sure what was said, but at some point during the conversation, they say Montoya shot Pacheco in the chest with the silver handgun.

Winder said it was not known how many shots were fired, but said that at least one shot struck Pacheco.

Several neighbors called 911 after the shooting. Pacheco was flown to Intermountain Medical Center, where he died.

Montoya's children were inside the house with other family members and didn't witness the shooting, Winder said.

Winder said several of Montoya's friends and family members live in the area, which is one reason they believed he was hiding in Kearns or Taylorsville.

Juanita Drew, who lives on the street where the shooting occurred, described Montoya as a neighborhood menace.

She said that as a teen he ran with gangs and she once had to call the police on Montoya.

About seven or eight years ago, she said, Montoya walked down the street to confront a neighbor kid.

Her husband intervened, telling Montoya to "keep on going, keep on going," and avoid the confrontation, Drew said.

Montoya responded to this by shooting a gun in the air, she said. Her husband backed off and the family called 911. She said police later found Montoya hiding in a field.

She said the house where the kids were dropped off is where Montoya lives, and that it belongs to Montoya's grandfather.

Hutson said it was unclear what the motive was in the shooting but it didn't appear to be a gang rivalry.

Court records show Montoya was charged in 2006 with four felony counts of theft by receiving stolen property, but those charges were dismissed. He was convicted of a misdemeanor charge of disorderly conduct in 2004.
