Salt Lake City police have finished an investigation into the off-duty sheriff's deputy who shot and wounded a man in a bar melee.

Detective Dennis McGowan said the case will be sent to county prosecutors, who will determine whether the deputy, Rudy Chacon, was within in the law when he shot the man or if criminal charges should be filed.

The case is scheduled for review Nov. 18, confirmed Alicia Cook, a spokeswoman for the Salt Lake County District Attorney's Office.

On Sept. 19, a fight began on the upstairs dance floor at Green Street Social Club. Chacon, a narcotics detective, fired one pistol shot that struck 26-year-old John Junior Pikula's left arm, hit a rib and ricocheted into his colon.

Pikula's lawyer has said his client was not acting aggressively toward Chacon and the fight was ending when Chacon fired. The lawyer also has said Chacon had been drinking at the bar.
