An Orem businessman charged with first-degree felony murder in the fatal shooting of his brother-in-law has asked a judge to lower his bail.

Stephen E. Strate was released Tuesday from jail after posting bond with a $1 million cashier's check. On Friday, his attorney filed a motion in Provo's 4th District Court to have the amount reduced.

A hearing on the motion will be set later. Strate's next court appearance is scheduled for Dec. 3.

According to court records, Strate called 911 on Oct. 25 to report the shooting. The records say the 54-year-old told the dispatcher, "He came at me with a damn chair."

Police found Marvin Sidwell, 51, dead in the basement of an Orem home near 400 South and 300 West. A .380-caliber semi-automatic handgun, which was identified as the weapon used, was found on the porch of the home. The home is owned by Strate's mother-in-law.

Strate is the owner of Steve Strate Crane Service.
