A former Murray police detective was sentenced to two years in jail Monday for sexually abusing a teenage girl during a five-year period.
Michael D. Spilman, 35, was charged with one count each of first-degree felony aggravated sexual abuse of a child, second-degree felony forcible sexual abuse and class A misdemeanor sexual battery.
As part of a plea bargain, Spilman pleaded guilty last month in 3rd District Court to two second-degree felony counts of forcible sexual abuse, and has been held in jail since January on $150,000 bail.
Spilman faced a possible prison term of up to 30 years. Judge Dennis Fuchs ordered two years of jail time and 36 months of probation, which includes completion of sex-offender treatment and payment of a $5,000 fine. Spilman is not allowed contact with children under 18 years of age.
Defense attorney Catherine Roberts asked for leniency, in light of Spilman's experience as a law enforcement officer and behavior as a model prisoner.
But the judge called Spilman's law enforcement career "a double-edged sword," saying that as a police officer he "should have known better" and "sought help earlier."
Fuchs also said he was concerned that the assault continued for five years. Spilman also became "extremely aggressive" with the victim as the abuse continued, Fuchs said, eventually forcing her to the ground and fondling her.
Despite his concerns, Fuchs ordered jail and probation instead
Apologizing to the victim, Spilman said was "ashamed" of his actions. He added that he hoped to be released soon, to see his son and to secure a job. Roberts noted that Spilman's wife intends to file for divorce.
Between March 2004 and January 2008, Spilman fondled the girl, who is now 17, over and under her clothing at his Salt Lake County home, according to charging documents.
Spilman -- who spent more than nine years on the Murray police force -- resigned Jan. 12, one day before charges were filed.
