A former Davis High School teacher has been charged with additional felony counts after a third teenage boy claimed he had sex with her.

Brianne Altice, 35, is now facing 10 felony counts for alleged sexual relationships with three teens: five counts of first-degree felony rape, two counts of first-degree felony forcible sodomy and three counts of second-degree felony forcible sexual abuse in connection with allegedly having sex with the three male students.

The first-degree felonies carry the possibility of life in prison.

A Jan. 15 preliminary hearing has been set in 2nd District Court to hear evidence from the third teen, according to prosecutors. According to charging documents, Altice allegedly had sexual contact with the 17-year-old boy between August and September of last year.

Altice was arrested in October 2013, and initial charges were filed in December 2013.

Deputy Davis County Attorney Cristina Ortega said Thursday that one charge of first-degree felony rape — filed in November in an amended information — is connected to the third teen.

At a preliminary hearing in February, the first boy testified that he was 16 years old when he had several sexual encounters with Altice between January and September of 2013. At that hearing, a judge found there was probable cause and ordered her to stand trial on three counts of rape and one charge of forcible sodomy.

In October, a second teen testified at another preliminary hearing that he was 17 years old when a relationship with Altice took place between April and June of last year — a relationship that began with kissing between class periods and eventually led to intercourse, he said.

After that hearing, Judge John Morris ruled there was probable cause for Altice to stand trial on one count of rape and one count of forcible sodomy, and also approved the addition of three additional charges of forcible sexual abuse.

Altice's attorney, Edward Brass, filed a motion in early November asking for separate trials for each of the alleged victims, arguing that the alleged acts were "not part of a common scheme or plan."

Brass said in another motion — filed before charges were filed in connection a third alleged victim — that Altice claims the sexual relationships didn't happen.

"It is her defense that they did not happen at all," Brass wrote. "That she never engaged in any inappropriate contact with either of her students ..."

Prosecutors say the teacher acknowledged to investigators that she had engaged in sex with the 16-year-old boy on two occasions.

But Brass has asked the judge to not allow those statements at her trial, arguing that she was intimidated by the eight to 10 male officers who came to her home last October to interview her about the allegations.
