A prosecutor is considering misdemeanor charges against the mother of the sword-carrying man fatally shot by Saratoga Springs police.

Saratoga Springs police spokesman Owen Jackson confirmed Friday that, "On Oct. 19 there was an incident" involving Susan Hunt and two officers. The mother of the late 22-year-old Darrien Hunt came upon an unrelated traffic stop being conducted by police in a Wal-Mart packing lot, and pulled up behind the officers' cruiser.

Jackson, citing the ongoing investigation into the incident, would not provide further details. He did confirm that due to potential conflict of interests, the altercation was investigated independently by the Utah County Sheriff's Office.

KUTV reported Hunt pulled up behind a pair of police officers during an unrelated traffic stop of another motorist and began verbally and physically assaulting them.

Neither Susan Hunt nor her attorney, Robert Sykes, had returned inquiries seeking comment on the allegations as of Friday afternoon.

However, Sheriff's Sgt. Spencer Cannon said detectives had completed their investigation and referred their results back to Saratoga Springs police and the city's prosecutor.

As of Friday, Susan Hunt had neither been cited nor arrested. Jackson said the potential charges would be screened by both City Attorney Kevin Thurman — who also did not return inquiries on Friday — and an as yet unspecified outside agency.

Utah County Attorney Jeff Buhman, whose office is expected to announce its decision next week whether officers who shot Darrien Hunt will be prosecuted, said his office was not involved in screening the potential case against Susan Hunt.

"I'm aware of the allegations, but we don't have this case in our system. This will probably involve misdemeanors, something we would not handle," Buhman said.

In the Sept. 10 incident, Saratoga Springs police claim Darrien Hunt swung a samurai sword at them — an account also allegedly reported by eyewitnesses — before they chased and fatally shot him.

Sykes and Susan Hunt have alleged the shooting amounted to excessive and unnecessary force, since Darrien Hunt was running away at the time he was shot and was not a threat to officers. The family also has raised the issue of the deceased's biracial background as figuring into the outcome.

Police counter that they shot to stop Hunt because he was a danger to the public.

Autopsy results show Hunt was shot six times from behind.
