Charges have been dismissed against a former Davis School District principal who was accused of assaulting his wife, after she invoked spousal privilege and refused to testify against her husband.

Donald Beatty, 54, was arrested and charged in May with class B misdemeanor counts of domestic violence assault, unlawful detention, threats of violence and interruption of a communication device.

All four charges were dismissed Tuesday by Davis County Justice Court Judge John Ynchausti, after prosecutors filed a motion stating that without the woman's testimony there was insufficient evidence to prosecute the case.

On May 27, Beatty held the woman against her will at their West Point home when she tried to leave a room before finishing a conversation, according to a probable cause statement.

He allegedly closed the door when she tried to leave, tackled her to the floor and straddled her to prevent her from using a cellphone to call for help. She was attempting to call her son, whom Beatty allegedly threatened to kill if he came to the house, according to the probable cause statement.

The woman escaped and was outside when officers arrived.

On Aug. 12, the woman filed an invocation of spousal privilege, stating "I will not testify against the defendant in this matter."

On June 2, she had filed for a protective order against Beatty. That case was dismissed on Tuesday, after both parties submitted a stipulated motion to dismiss the protective order, court records show.

Beatty, who had been listed as the principal of Antelope Elementary in Clearfield on the Davis County School District website, was placed on paid administrative leave on May 31, three days after charges were filed.

District officials said Wednesday that Beatty was still an employee, but had been reassigned on July 18 as an administrator in the digitial teaching and learning program.
