The funeral for Robert "LaVoy" Finicum, the Oregon wildlife refuge occupier who died, will be in Utah.

Finicum's funeral is scheduled for Feb. 5 in Kanab, according to a family statement.

Video of the fatal police shooting appears to show Finicum reaching into his jacket before he fell into the snow. The FBI said the man had a loaded gun in his pocket. Authorities played the FBI video Thursday amid claims that Finicum did nothing to provoke officers in the confrontation Tuesday on a remote Oregon high-country road.

"At this point we will await the outcome of any investigation, but based on the information currently available to us, we do not believe LaVoy's shooting was justified," his family's statement reads.

His family also stated that, from what they understand, the standoff "was on track to a peaceful resolution."

"Unfortunately, the powers that be were not interested in being patient enough for the occupation to come to a peaceful end," their statement adds.

The occupation by ranchers and others began on Jan. 2, and at one point there were a couple of dozen people holed up, demanding that the federal government turn public lands over to local control. But the compound has been emptying since the arrest of leader Ammon Bundy and 10 others over recent days and with the death of Finicum.

Four occupiers remained at the Malheur National Wildlife Refuge on Friday afternoon and refused to leave without assurances they wouldn't be arrested. The FBI said it was negotiating with them.
