Democratic delegates in the south end of Salt Lake City chose former Rep. Lynn Hemingway to replace Rep. Justin Miller, who resigned after pleading guilty to fraud charges last month.

Hemingway had represented the district from 2006 until retiring in 2014, when Miller won the election to replace him.

Hemingway defeated Amy Fowler and Christopher Stout to win the seat.

"We welcome Lynn back into the caucus. He has been a stalwart member of the caucus who strongly represents House District 40 with every issue he takes on," said House Minority Leader Brian King, D-Salt Lake City. "Lynn will be a great representative, and the caucus is glad to have him back."

Miller announced his resignation in October after pleading guilty to communications fraud, stemming from allegations that he had embezzled about $25,000 from Salt Lake County Mayor Ben McAdams' campaign, which he managed.

The party will send Hemingway's name to Gov. Gary Herbert, who is required to formally appoint him to fill the vacancy. Hemingway is expected to be sworn in early next week.

Salt Lake County Democratic Party Chairwoman Clare Collard thanked all the candidates who ran.

"They represented the Democratic Party well, and we are proud of them," Collard said. "We, along with the residents of House District 40, are excited to welcome back Representative-elect Hemingway. We look forward to working with him and the rest of the Democratic delegation on the issues that affect the everyday lives of Utahns."
