Court sets date to hear challenges on vouchers

The Utah Supreme Court will hear arguments from both sides of the school voucher debate on June 8. The court on Thursday consolidated two separate challenges to the voucher referendum ballot title and set the hearing date.

A successful referendum petition drive will let the public vote Nov. 6 on whether to repeal Utah's school voucher law - which would provide private school tuition assistance. Supporters and opponents of vouchers want the ballot to say whether voters can kill the program or merely modify it.

Pro and con arguments for voter information pamphlets were due today, but the court postponed that deadline indefinitely. It set a June 6 deadline for additional materials to be filed, but said, "parties in both cases are advised to resist the temptation to file additional materials that . . . re-argue issues already adequately raised."

It also urged everyone to stick to the legal matters at hand.

"General discussion of the virtues or vices of any particular political or philosophical position . . . are not expected to be helpful," the order said.

Chief Justice Christine Durham recused herself from the proceedings but was unavailable to explain why Thursday.
