Prosecutors charged a man Friday for a brutal rape in a Burger King bathroom.
Justin Loyd Martinez, 25, now faces first-degree felonies for aggravated rape and aggravated kidnapping as well as a class B misdemeanor for DUI. The charges stem from an incident that police say happened just before 3 a.m. Sunday at the Burger King near 3500 S. 5600 West in West Valley City.
According to police, Martinez followed a woman inside the bathroom and brutally attacked her. Court documents filed Friday state he repeatedly punched the woman in the face, slammed her against the wall and threatened her. He then knocked her to the ground and continued the assault and rape.
The woman fought back and scratched Martinez’s face, court documents state. She also felt like she couldn’t breathe. The documents add that she told police she “put up a pretty good fight for as long as I could.”
Eventually the woman’s friend, who was waiting outside the Burger King, became concerned and went inside. She saw the woman lying on the floor inside a bathroom stall, the court documents state, but a man pushed the stall door shut. He later opened the stall and walked out.
“The victim was able to scratch the suspect multiple times, and she also grabbed a jacket the suspect had been carrying,” police said after the incident.
The jacket helped to identify Martinez, police wrote. They arrested him Tuesday as he was leaving the state driver license office in West Valley City.
The woman suffered multiple strikes to the face and head, said West Valley City police Sgt. Jason Hauer. She was doing well considering the circumstances, Hauer added.
A court docket does not currently show any scheduled hearings in Martinez’s case.
