New law may sting man accused of raping girl, 12

A 38-year-old Saratoga Springs man accused of engaging in sexual activity with a child could be eligible for increased penalties under the state's version of Jessica's Law. Don Dean Mander was charged Tuesday in 4th District Court with rape of a child and sexual abuse of a child, both first-degree felonies. According to a new law that became effective May 5, Mander could face a 25-year-to-life prison term if convicted of rape of a child. Sexual abuse of a child carries the potential for a prison term of six, 10 or 15 years to life. Mander was arrested May 5 near his home and booked into the Utah County jail on suspicion of aggravated kidnapping, child rape and forcible sexual abuse of a child. Police said Mander used a position of trust to gain control of his victim, a 12-year-old girl. According to a police affidavit, the girl was related to Mander. She told police Mander pulled down her pants and underwear and then sexually assaulted her at her grandparents' home, where Mander also lived. She said she asked him to stop several times during the assault, which took place around April 21. Mander allegedly covered the girl's mouth during the assault and told her to "shut up" as she screamed in pain, the affidavit states. - Stephen Hunt
