Posted: 1:56 PM- A court hearing for former Utah County Commissioner David Gardner has been delayed until Aug. 7.

Gardner, 52, is charged with class A misdemeanor sexual battery for allegedly fondling a 26-year-old woman during a car ride in late April.

Gardner's case originally was set to be heard Monday in Spanish Fork's 4th District Court.

In early June, the case was assigned to Judge John Backlund and shifted to Orem's 4th District Court. A pretrial conference had been set for July 17.

But at the request of Michael Esplin, Gardner's attorney, the conference has been rescheduled for Aug. 7 at 11 a.m. Gardner had prior run-ins with the law, including two drunken-driving charges and a disorderly-conduct conviction for roughing up a 9-year-old boy.
