Posted: 9:26:25 AM- A judge has set a two-day preliminary hearing date in October for Craig Gregerson, charged in the murder of 5-year-old Destiny Norton.

As Gregerson entered a downtown Salt Lake City courtroom Monday morning, he wore a protective vest, handcuffs, and a tight-lipped smile.

After a two-minute scheduling hearing, one of Gregerson's attorneys said the defense team had not approved a jailhouse interview given by Gregerson to a local news channel. In the interview, Gregerson cited a problem with pornography and made an apology.

"Of course not," said attorney Ralph Dellapiana Monday when asked if he had sanctioned the interview.

Lead prosecutor Robert Stott on Monday declined to comment on the interview, or whether pornography would be a viable defense for Gregerson.

Stott said his office was preparing for a trial, and delivered a large box of all the documents the state has to the defense Monday morning.

Third District Judge Judith Atherton asked Gregerson in court if he was willing to waive any challenges regarding his speedy trial rights.

He answered: "Yes I am, your honor."

The Norton family did not attend Tuesday's hearing. A preliminary hearing will be held Oct. 3 and 4.

The 20-year-old Gregerson is charged with capital murder. Investigators found Destiny's body in his basement eight days after she disappeared July 16 from her Salt Lake City home.
