Walker considering guilty plea to a technical violation of state law

Former state lawmaker Mark Walker has agreed to plead guilty to a technical violation of election law, his attorney Jim Bradshaw announced Tuesday, but the move is not yet a done deal.

"He will not plead guilty to bribery allegations," Bradshaw said, noting that final negotiations have yet to be worked out.

This development came within hours of Davis County Attorney Troy Rawlings and Weber County Attorney Mark DeCaria releasing that the investigation into bribery allegations in the state treasurer's race would go to a grand jury.

"We will contact Mark Walker's attorney and have discussions and find out what he's proposing," Rawlings said mid-day Tuesday.

Bradshaw hopes to negotiate a plea that centers on a provision of the law pertaining to which agreements may or may not be reached in the course of an election.

According to Bradshaw, if Walker's plea is accepted, he will be removed from the grand jury investigation, which should continue without him.

"That will be confirmation of what Mark Walker has maintained all along, that there were others that participated in the discussion," Bradshaw said.

In March, Walker allegedly told Chief Deputy State Treasurer Richard Ellis, his opponent in the Republican primary, that Ellis could keep his job and get a $55,000 raise if he would drop out of the race.

The discussion between Ellis and Walker was said to have been brokered by Zions Bank Executive Carl Empey. Walker allegedly told Ellis that a leading Republican lawmaker assured him the pay raise could happen.

Walker is eager to get on with his life and put this chapter behind him, Bradshaw said.

"He has no interest in pursuing anything in politics at this point."
