Roy skin-care firm fate unclear after raid by U.S. Marshals

A Roy skin-product company raided by U.S. Marshals still isn't commenting on why it refused to destroy its contaminated products.

The government agents on Friday seized $2.7 million worth of skin sanitizers and protectants, as well as ingredients and components, after Clarcon Biological Chemistry Laboratory refused to promptly destroy them following a voluntary recall in June.

No one at the company answered the phone Monday.

Such raids are fairly uncommon, according to FDA spokesman Christopher Kelly. In fiscal 2008, the agency conducted eight seizures.

Whether Clarcon will remain open in the wake of the recall and raid is unclear.

"We're not in a position to comment because it's pending litigation," Kelly said.

Clarcon's contaminated products -- which are promoted as antimicrobial agents that treat open wounds and damaged skin, as well as protect against infectious diseases -- contained high levels of potentially disease-causing bacteria, according to the FDA. Some of the bacteria can cause skin and tissue infections, which may need medical or surgical attention and may result in permanent damage.

During the raid, U.S. Marshals seized 103,338 bottles of finished product, thirty 55-gallon barrels of bulk ingredients and finished product, about 12 bags of bulk ingredients, and 1,018 gallons of finished product from bulk containers, Kelly said.

So far, no cases of injury have been reported.

An FDA inspection revealed Clarcon deviated from the agency's Current Good Manufacturing Practice regulations, including poor practices that permitted the contamination.

Since 2007, the company has produced and distributed more than 800,000 bottles of products around the country.
