High court to hear challenge of ruling barring FLDS attorneys

Posted: 5:45 PM- The Utah Supreme Court refused Thursday to halt a hearing on the proposed sale of land a polygamous sect claims is sacred.

But the court issued a provisional stay and granted a hearing on a ruling that disqualified attorneys Rod Parker, R. Scott Berry and the law firm of Snow, Christensen & Martineau from representing sect members in court action involving the United Effort Plan Trust.

Third District Judge Denise Lindberg disqualified the attorneys and their firm because they formerly represented the Fundamentalist Church of Jesus Christ of Latter Day Saints in actions involving the trust.

The court's stay also applies to an order requiring Snow, Christensen & Martineau to disclose documents related to its previous representation of the church to attorneys representing the court-appointed fiduciary now controlling the trust.
