Teenager suing bar over shooting

A teen who was shot after a fight in a South Salt Lake tavern is suing the bar, claiming it had inadequate security and shouldn't have let him inside because he was 17.

In a complaint filed this week, Brandon Craft claimed he was in the South Shore Bar, 2827 S. State St., on Jan. 14, 2007, when another patron threw a chair at him. The man, Craig Smith, was taken outside, and Craft asked to stay inside the bar for protection, the suit claimed. However, employees escorted him outside, where he was shot 15 times, the suit claims.

Craft claims bar staff knew he was younger than 18, and the shooting was a result of the staff letting him in the bar when they should not have. He also said the staff had a duty to act "in loco parentis" and keep him safe because they knew he was a minor. He also claims staff knew Smith posed a risk because he made threats to Craft while they were in the bar and because video footage would have shown Smith getting his gun from his vehicle. Knowing the threat, they should not have forced Craft to go outside, he claims.

The suit also names Smith, who was convicted of assault in the shooting and sentenced to up to five years in prison.

Craft claims he endured brain injuries, partial paralysis in his right side, the removal of his left eye, a gunshot to his scrotum, removal of parts of his small and large intestines, a colostomy, difficulty swallowing, respiratory failure, an abdominal abscess, a jawbone fracture, seizures and depression, among other injuries.

He claims his medical expenses have reached $386,000 and is seeking punitive damages of $1 million.
