D.A. says cops justified in fatal shooting in Millcreek, S. Jordan

A Salt Lake County Sheriff's Office deputy and sergeant were justified in using deadly force to kill a Millcreek man who was randomly firing a shotgun from his balcony last week.

That ruling was issued by the Salt Lake County District Attorney's Office on Wednesday afternoon.

Deputy Damien Gambill and Sgt. Randy Thomas both fired one shot at George Deray Huntzinger on June 26. Thomas' shot killed Huntzinger, the report states.

Police responded about 3 p.m. on June 26 to a call of shots fired at an apartment complex at 1012 E. Olympus Ridge Cove (4700 South). After Gambill and Thomas took up their positions, they saw Huntzinger standing on a third-story balcony. Huntzinger then walked down a stairwell to the ground level carrying a shotgun. Gambill asked him to drop his weapon, but Huntzinger turned and fired toward the deputy. Gambill returned fire but missed, the report stated.

Huntzinger returned to the balcony, raised his weapon and fired in the direction of officers below, the report stated. That's when Thomas fired one shot, hitting Huntzinger in the head and killing him.

In a separate incident, a South Jordan officer was also found justified in shooting and killing Wade Russell Pennington on May 29.

Officer Jared Nichols shot Pennington twice after he led police on a chase and rammed several patrol cars.

Nichols eventually was able to pin Pennington's SUV into a cul-de-sac, where Pennington continued revving his engine and trying to flee, the report states. He then lunged out of the window at Nichols who shot him twice.
