Judge fines Gardner for assault, warns ex-commissioner to get mental-health help or face jail

Posted: 10:26 AM- OREM - Former Utah County Commissioner David Gardner was fined $1,000 for simple assault and warned that he could go to jail if he doesn't get mental-health counseling or gets so much as a speeding ticket.

Fourth District Judge John C. Backlund also ordered Gardner not to have contact, without permission, with the victim, or any woman under 18 who was not a family member.

He originally was charged with sexual battery, a class A misdemeanor. He is a accused of grabbing a 26-year-old Payson woman and fondling and kissing her during a car ride in April 2007.

In May, he pleaded no contest to simple assault, a class B misdemeanor.

The victim said she wanted to see Gardner serve the maximum sentence because of the pain and trauma he caused her over the past 18 months. Paul DeWitt, Springville prosecutor, said he would not ask for jail time.

Backlund said he was inclined to give Gardner time behind bars for his lack of remorse and the fact that, as a psychologist, Gardner abused his training by taking advantage of his victim. The judge put the six-month jail sentence on hold.
